Van de Amerikaanse blogger en bibliothecaris Andy Woodworth las ik vandaag een artikel naar mijn hart, Why Wikileaks Matters to Libraryland. Hierin maakt hij duidelijk hoe de kwestie WikiLeaks raakt aan onderwerpen die zeer nauw aansluiten bij de kernfuncties van de bibliotheek, te weten netneutraliteit en digitale duurzaamheid, of met vrije toegang tot informatie een hoofddoelstelling is. Woodworth verwoordt de bibliothecaire verantwoordelijkheid voor die elementen als volgt:
Netneutraliteit:
It is up to the profession to be vigilant for such actions taken against digital information providers. It’s crucial to combat disruptions wherever they might be.”
Digitale duurzaamheid:
[…]to teach our patrons (especially the up and coming generations) about the implications of the online world in regards to privacy and personal content online. […] This is about teaching people about the positives and the perils of online life and how to take care of themselves in the new information age. If we are going to show our patrons the wonders of social media, we should do our best to put them on the path to good net citizenship.“
Vrije toegang tot informatie:
While not all in the profession may agree with the practices or publishing of Wikileaks, we do share a common cause in trying to share information that is meant to educate and enlighten. In going forth under this ideal, librarians must be willing to take up the banner and fight for these causes. Not simply for the sake of the library as an institution, but for the best of what is yet to come in a digital information future. What this represents goes well beyond the doors of the library and encompasses the world at large.”
In mijn ogen vormen de kwestie WikiLeaks, maar ook een zaak als Acta, een uitgelezen mogelijkheid voor bibliotheken om te tonen waarvoor zij staan. Eigenlijk kan je niet anders dan concluderen dat de thema’s, die allerminst prettig zijn, ons op een presenteerblaadje worden aangereikt. Of het leidt tot meer boekenlenende gebruikers, iets waar we voortdurend onterecht op worden afgerekend? Nee, dat waarschijnlijk niet, maar de sector kan hiermee wel aantonen dat zij digitale vraagstukken serieus neemt en een rol wil spelen in de bescherming van digitale burgerrechten. Dit is de tijd.

Edwin merkte het gisteren terecht op: “Die lui leren het echt nooit he…” Nee, sterker nog, in tegenstelling tot de voorgenomen vrijheidsbeperking op het internet, het ongenoemde doel van Acta, is het blokkeren van een Youtubefilmpje slechts kinderspel. Het gegeven dat het Europees Parlement inmiddels vóór de resolutie stemde toont aan dat het allerminst een ver-van-ons-bedshow is. In onderstaande video worden de gevolgen nog een keer helder neergezet.
Een indrukwekkende groep van juristen en rechtenprofessoren heeft een open brief aan Barack Obama geschreven met daarin een heldere boodschap: teken de huidige ACTA-tekst niet vóórdat hierover een openbaar debat plaatsgevonden heeft. De Verenigde Staten worden tijdens de onderhandelingen vertegenwoordigd door de United States Trade Office (USTR). Deze belangenbehartiger heeft er veel moeite in gestoken dit proces geen onderdeel te laten uitmaken van het publieke debat. In de open brief wordt deze houding, evenals gedane beloften, met de grond gelijkgemaakt:
The USTR has insisted that ACTA’s provisions are merely procedural and only about enforcing existing rights. These assertions are simply false. Nearly 100 international intellectual property experts from six continents gathered in Washington, DC in June, 2010 to analyze the potential public interest impacts of the officially released text. Those experts – joined by over 650 other experts and organizations – found that “the terms of the publicly released draft of ACTA threaten numerous public interests, including every concern specifically disclaimed by negotiators.” The expert statement notes that:
- Negotiators claim ACTA will not interfere with citizens’ fundamental rights and liberties; it will.[8]
- They claim ACTA is consistent with the WTO Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS); it is not.[9]
- They claim ACTA will not increase border searches or interfere with cross-border transit of legitimate generic medicines; it will.[10]
- And they claim that ACTA does not require “graduated response” disconnections of people from the internet; however, the agreement encourages such policies.[11]

Onder andere het werk van Walter Benjamin komt in 2011 in het publieke domein.
De Open Knowledge Foundation heeft een blogpost, Which works enter the public domain in 2011?, gewijd aan auteurs wiens werk vanaf 1 januari 2011 tot het publieke domein gaat behoren. In principe geldt dit voor elke auteur die is komen te overlijden in 1940 en waarbij de auteursrechtperiode van 70 jaar verlopen is. Beroemde schrijvers en kunstenaars waarvoor dit geldt zijn onder andere F. Scott Fitzgerald, Walter Benjamin en Paul Klee. Een overzicht van werken die zich in het publieke domein bevinden is onder andere Public Domain Works. Het op 2011 toegespitste overzicht, met daarin 661 auteurs, is hier te vinden.
